Federal "Title VI and ADA/Nondiscrimination" Protections

The Old Colony Metropolitan Planning Organization (Old Colony MPO) operates its programs, services, and activities in compliance with federal nondiscrimination laws including Title VI of the Civil Rights Act of 1964 (Title VI), the Civil Rights Restoration Act of 1987, and related statutes and regulations. Title VI prohibits discrimination in federally assisted programs and requires that no person in the United States of America shall, on the grounds of racecolor, or national origin (including limited English proficiency), be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity receiving federal assistance. Related federal nondiscrimination laws administrated by the Federal Highway Administration, the Federal Transit Administration, or both prohibit discrimination on the basis of agesex, and disability. These protected categories are contemplated within the Old Colony MPO’s Title VI Programs consistent with federal interpretation and administration. Additionally, the Old Colony MPO provides meaningful access to its programs, services, and activities to individuals with limited English proficiency, in compliance with US Department of Transportation policy and guidance on federal Executive Order 13166.

State Nondiscrimination Protections

The Old Colony MPO also complies with the Massachusetts Public Accommodation Law, M.G.L. c 272 §§ 92a, 98, 98a, prohibiting making any distinction, discrimination, or restriction in admission to or treatment in a place of public accommodation based on race, color, religious creed, national origin, sex, sexual orientation, disability, or ancestry. Likewise, the Old Colony MPO complies with the Governor’s Executive Order 526, section 4 requiring all programs, activities, and services provided, performed, licensed, chartered, funded, regulated, or contracted for by the state shall be conducted without unlawful discrimination based on race, color, age, gender, ethnicity, sexual orientation, gender identity or expression, religion, creed, ancestry, national origin, disability, veteran’s status (including Vietnam-era veterans), or background.

Alternative Accessible Access Formats Statement

The Old Colony Planning Council ensures early, inclusive, accessible and continuous public participation and input to the planning process for decision making and continuing opportunities for the public to express their views on issues and to become active participants in the decision-making process.

Planning materials are accessible to people with disabilities and those with limited English proficiency. Locations for all sponsored meetings are accessible to people with disabilities and are near public transportation when feasible. Upon request (two weeks in advance), every effort will be made to provide accommodations such as assistive-listening devices, materials in accessible formats and in languages other than English, and interpreters in American Sign Language and non-English languages. Accessibility accommodations and language services will be provided free of charge, upon request, as available.

Environmental Justice

The objective of Environmental Justice is to ensure that there is equity in the distribution of transportation resources and services for communities or populations classified as minority or low income, as well as equity in the distribution of impacts from projects. As part of this objective, Metropolitan Planning Organizations are required to provide full and fair participation for all socio-economic groups throughout their planning and decision-making processes. This means that all groups should harvest the benefits of transportation projects and equally bear any adverse impacts from them as well. Title VI of the Civil Rights Act of 1964 prohibits discriminatory practices in federally funded programs. The Title VI report published by the Old Colony MPO demonstrates compliance with the requirements of Title VI. The most recent Title VI Report is linked here.

Complaint Filing

The following Complaint Procedures are established to meet the requirements of the Title VI of the Civil Rights Act of 1964 (Title VI) and related state and federal nondiscrimination authorities, including the Americans with Disabilities Act (ADA). To file a complaint alleging discrimination, please utilize either the Title VI or ADA Complaint Procedures listed below, whichever is relevant. 

Title VI Complaint Procedure

A Title VI Complaint may be filed by anyone who is alleging discrimination on the basis of race, color, or national origin, including language. Instructions on how to file a complaint are provided on pages 2-5 of the Title VI Complaint Procedures. The Title VI Complaint Procedures and Complaint Forms can be found at the bottom of this page.
 
The complaint should be submitted by the complainant and/or his/her designee as soon as possible, but no later than 180 calendar days after the alleged violation to:

Americans with Disabilities Act (ADA) Complaint Procedure 

The ADA Complaint Procedure may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in employment practices and policies or the provision of services, activities, programs, and benefits by Old Colony Planning Council.

The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing a complaint such as personal interviews or a recording of the complaint, will be made available for persons with disabilities upon request. 

The complaint should be submitted by the complainant and/or his/her designee as soon as possible, but no later than 300 calendar days after the alleged violation to:
